1. Acceptance of Terms By accessing calmwaterpools.com or placing an order with Calm Water Pools, LLC, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or purchase our products.

2. Product Specifications & Manufacturing All fiberglass pool shells are manufactured by Latham Pools. Dimensions, weights, and water capacities listed on our website are approximate and provided by the manufacturer. Due to the nature of fiberglass composite manufacturing, variances of up to 3% in length, width, and depth are considered within industry tolerance and do not constitute a defect.

3. Orders and Payment

  • Deposits: A non-refundable deposit is required to place a pool shell into the production schedule.

  • Final Payment: The remaining balance must be paid in full prior to the scheduling of shipment. We do not offer terms or credit; all funds must be cleared before the pool leaves the manufacturing facility.

4. Shipping and Delivery Policy

  • Curbside Delivery: Unless explicitly contracted for installation, our obligation is to deliver the pool shell to the curbside or the nearest accessible point at the delivery address.

  • Customer Responsibility for Offloading: The customer is solely responsible for providing the necessary equipment (typically a crane or excavator) and personnel to offload the pool shell from the delivery truck immediately upon arrival. Detention charges may apply if the truck is delayed at the site.

  • Site Access: The customer warrants that the delivery site is accessible by a 70-foot tractor-trailer. Any towing or recovery fees incurred due to inaccessible roads are the responsibility of the customer.

5. Inspection and Damage

  • Mandatory Inspection: The customer (or their agent) must inspect the pool shell immediately upon arrival, while it is still on the truck.

  • Bill of Lading: Any damage, scratches, or defects must be noted on the Bill of Lading before signing. Failure to note damage at the time of delivery constitutes acceptance of the merchandise “as is” and may void your right to file a shipping claim.

6. DIY Installation Disclaimer For customers purchasing “Shell Only” or “DIY Packages”:

  • Calm Water Pools acts solely as a supplier. We do not warrant the installation work performed by the customer or third-party contractors.

  • Improper installation—including incorrect backfill materials, failure to install a hydrostatic valve, or improper leveling—can void the manufacturer’s structural warranty.

  • The customer assumes all liability for compliance with local building codes, zoning laws, and safety barrier requirements.

7. Manufacturer Warranty The pool shell is covered by the Latham Pools Limited Lifetime Structural Warranty and Surface Warranty, subject to the terms and exclusions set forth by Latham Pools. Calm Water Pools is an authorized dealer but is not the warrantor of the product itself. Warranty claims must be directed to the manufacturer.

8. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
